Welcome to ELYX Beauty. These Terms and Conditions (“Terms”) govern your access to and use of the ELYX Beauty website, products, services, accounts, checkout functionality, and related features.

ELYX Beauty is operated by KPO Investments (“ELYX Beauty,” “we,” “our,” or “us”). By accessing our website, creating an account, placing an order, or purchasing a product, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, please do not use our website or purchase our products.

1. Eligibility and Website Use

ELYX Beauty offers beauty, skincare, body care, cosmetics, and related personal care products. We make reasonable efforts to accurately describe products, ingredients, sizes, quantities, colors, packaging, pricing, availability, and product photographs. Packaging, appearance, ingredients, labeling, colors, formulation, or presentation may occasionally change. Screen colors may also differ from the physical product because of device settings, photography, lighting, and display characteristics.

3. Individual Results

Beauty and personal care products may produce different results for different individuals. Results may depend on skin type, personal sensitivities, frequency of use, existing routines, environmental conditions, other products being used, and individual characteristics. We do not guarantee any particular beauty, skincare, cosmetic, or appearance-related result. Testimonials, reviews, photographs, or customer experiences represent individual experiences and are not guarantees.

4. Product Use and Sensitivities

Customers are responsible for reviewing product descriptions, ingredient information, instructions, warnings, and usage recommendations before use. Customers with known allergies, sensitivities, medical conditions, or concerns regarding particular ingredients should carefully review product information before purchase or use. Where appropriate, customers may wish to perform a patch test before broader application. Discontinue use if significant irritation or an unexpected reaction occurs and seek appropriate professional guidance when necessary.

Our products and website information are intended for cosmetic and general informational purposes and are not intended to diagnose, treat, cure, or prevent disease. Website information is not a substitute for professional medical advice.

5. Orders

Submitting an order constitutes an offer to purchase the selected products. An automated confirmation acknowledging receipt of an order does not necessarily constitute final acceptance. We may, where reasonably necessary, accept or decline an order, cancel an order, limit quantities, request additional information, verify billing or shipping details, verify payment authorization, or review transactions for fraud or security concerns. If we cancel an order after funds have been successfully collected, an applicable refund will generally be returned to the original payment method.

Prices are displayed in the currency indicated on the website or during checkout. We make reasonable efforts to maintain accurate pricing and product information, but typographical, technical, pricing, or listing errors may occasionally occur. Where an obvious error occurs, we may correct the listing and cancel or adjust affected orders as permitted by law. Orders must be paid using an available checkout payment method. Payment services may be provided by independent third-party payment processors. By submitting payment information, you represent that the information is accurate, you are authorized to use the selected payment method, and you authorize charges associated with your order. We may use fraud-prevention and payment-verification systems. ELYX Beauty generally does not directly store complete payment card numbers.

8. Shipping and Delivery

Customers are responsible for providing complete and accurate delivery information. Shipping and delivery dates are estimates unless expressly identified as guaranteed. Delays may occur because of circumstances outside our reasonable control, including carrier delays, severe weather, holidays, transportation problems, address errors, natural disasters, government action, or operational disruptions. 9. Incorrect Shipping Information

Customers should carefully review shipping details before submitting an order. We cannot guarantee that an address can be changed after an order has entered fulfillment or shipment. Where permitted by law, additional costs resulting from incorrect or incomplete customer-provided shipping information may be the customer’s responsibility.

10. Returns, Refunds, and Exchanges

Returns, refunds, replacements, exchanges, damaged items, and other post-purchase matters are governed by our Refund & Return Policy. Nothing in these Terms or that policy is intended to limit consumer rights that cannot legally be waived.

11. Promotions and Discounts

ELYX Beauty may periodically offer discounts, bundles, sales, promotions, complimentary products, or other offers. Unless otherwise stated, promotions may not be combined; may be limited by customer, household, product, or order; may exclude certain products; may expire; generally have no cash value; and may be modified or discontinued where legally permitted. We may reject transactions involving suspected fraudulent or abusive promotional activity.

12. Customer Accounts

Customers may be able to create accounts. Account holders are responsible for maintaining login confidentiality, providing accurate information, restricting unauthorized access, and promptly reporting suspected account misuse. You are responsible for activity conducted through your account to the extent permitted by applicable law.

13. Reviews and User-Submitted Content

Customers may be able to submit reviews, comments, photographs, feedback, or similar content. You may not submit content that is unlawful, fraudulent, misleading, infringing, abusive, threatening, defamatory, malicious, or invasive of another person’s rights.

By voluntarily submitting content for public use, you grant ELYX Beauty and KPO Investments a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, distribute, and promote that content in connection with our business, subject to applicable law. You retain ownership of your original content.

14. Intellectual Property

Website materials including brand names, logos, product names, graphics, photographs, descriptions, written content, videos, icons, designs, layouts, and marketing materials are owned by, licensed to, or lawfully used by ELYX Beauty and/or KPO Investments unless otherwise stated. Such materials may be protected by intellectual property laws. Our website may interact with third-party services such as payment processors, shipping carriers, analytics platforms, marketing services, or social media platforms. Third parties operate independently. We are not responsible for their content, security practices, availability, privacy practices, or contractual terms.

16. Website Availability

We make reasonable efforts to maintain a reliable website but cannot guarantee uninterrupted or error-free access. The website may occasionally be unavailable because of maintenance, updates, technical problems, security measures, infrastructure problems, or circumstances outside our control.

17. Disclaimer of Warranties

To the fullest extent permitted by law, our website and related services are provided on an “as is” and “as available” basis. Except for rights or warranties that cannot legally be excluded, we do not guarantee uninterrupted access, entirely error-free information, specific individual product results, or suitability of every product for every individual. 18. Limitation of Liability

To the fullest extent permitted by applicable law, ELYX Beauty and KPO Investments will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or relating to website use or inability to access the website, unauthorized third-party access, third-party platforms or services, shipping delays beyond our reasonable control, improper product use, or individual cosmetic results. Liability will not be excluded or limited where applicable law prohibits such exclusion or limitation.

We are not responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, carrier disruptions, fires, infrastructure failures, labor interruptions, government actions, public emergencies, supply-chain interruptions, or similar events.
